The necessity of making a will

Without a will, the process for determining an inheritance will be time consuming and expensive in Malaysia.

In the many years that we have been assisting our clients in applying for MM2H visas and purchasing Malaysian real estate, we have encountered many different cases.In particular, we have encountered quite a few cases where the person who purchased the Malaysian real estate died and did not prepare a will in Malaysia, which resulted in a difficult situation.

If a person who owns real estate in Malaysia passes away without a will in Malaysia, his or her heirs (wife and/or children) must file a petition with the Malaysian court to obtain approval in order to inherit the property. It takes a considerable amount of time, in some cases taking over a year. Applications for this approval also has to go through legal agencies resulting in various legal fees being charged in the process. Resale of any properties will also be delayed.


Even in the event that the property is purchased jointly with your spouse, in the absence of a will, your spouse will not be able to inherit the property, and is required to obtain court approval.

Even with approval for the inheritance, an inheritance will be distributed according to the laws of Malaysia in a designated ratio, which may differ from the ratios in your country of origin.

If you have a will in your home country, it will be an expensive and time consuming, if not impossible endeavor to have it executed in Malaysia, as most wills do not apply to assets overseas.

To ensure a smooth inheritance process of your assets in Malaysia, it is essential to make a will in Malaysia.

Even if you do not own real estate, it is would be difficult to uplift timed deposits, or cash in other financial products.

Proof of cancellation for the MM2H visa is required to lift the lien placed on the MM2H visa timed deposit.
As of January 2019, dependents of MM2H visa holders without a will are required to file a petition with the court and obtain approval for the cancellation, in a process very similar to the one required for real estate.
A will would ensure a much smoother cancellation process for the MM2H visa in the event of the death of the main holder.。


It would be much safer to make a will if you plan to create or currently possess any other bank deposits / financial products.
While there are banks which allow the surviving spouse to withdraw deposits in the event of a death, not all financial institutions allow for this transfer.
